Written by the lawyer who was the Whistleblower in the Rothstein Ponzi Scheme run out of the Ft. Lauderdale, Florida Law Firm of Rothstein, Rosenfeldt and Adler. This is a wonderful book that exposes massive corruption operating in plain sight and known by many yet allowed to continue for years. The author finds a way to weave the true shocking story of the corruption and all those who participated and let it continue, with the most wonderful, uplifting stories of regular people in his own community of North Miami Beach just a few miles away, doing extraordinary things for their neighbors.
The law firm was on Las Olas Blvd almost across the street from the downtown Ft. Lauderdale Courthouse. Among some of the charges, the lawyers/firm forged judge's signatures on fake documents shown to potential investors as they monetized the cases. Many lawyers were charged and lost their licenses. 28 or so lawyers from Ft. Lauderdale, Florida went to jail, although many did little time despite the gravity of the criminal conspiracies. Scott Rothstein is doing 50 years in Federal Prison. The brave, ethical and smart author broke open the case and then in this book he contrasts this large scale unethical, criminal and corrupt operation with some amazing human beings on the other end of the spectrum just a few miles south within the community of North Miami Beach where he lives.
What a treat! Here is the audio of an interview with the author. It is shocking to hear how these lawyers monetized their legal work, offering investors portions in the proceeds from a regular lawsuit. So, you go to a lawyer in south Florida to help you with your legal case and behind the scenes they were and are marketing your potential winning judgement to investors. Incredible!

Lynn mentions if she had a choice of getting her whistleblower millions or seeing these corrupt criminals prosecuted, she would have chosen seeing the criminals charged and prosecuted. She goes on to explain how so many people have been impacted and that many of those people helped in her research. She had many volunteers, even a group of oncology nurses and people across the nation sending her information. Lynn also mentions that during this time, at one point fighting the banks she considered herself lucky if she had $12. in her bank account. She was able to pay the electric bill and sometimes put gas in her car...and yet she persevered and broke open this nationwide scandal.

As you watch the above 60 minutes segment of the interview with Lynn Syzmoniak, and then the interview with Sheila Bair who was the then Chair of the Federal Deposit Insurance Corp during the financial crisis (and is now as of late 2020 a board member of Fannie Mae), understand that almost nothing was done to these ORGANIZED CRIMINAL FRAUDSTERS to hold them accountable. They should have been in jail. As you watch this segment, you will come to understand why I say this.. This was organized fraud on a national scale and should have been prosecuted under the Federal and State R.I.C.O. acts, (Racketeer and Influenced Organization Act) and yet no one went was prosecuted and no one went to jail. There were fraudlent documents submitted in most of these cases. Not only were the fraudulent documents submitted to the court in order to take homeowners' homes, but the fraudulent documents were not just found and relied upon, but worse the documents were created to assist in the fraudulent foreclosures. Contrast that with one attorney who was prosecuted. One attorney in Pasco County Florida was convicted of altering mortgage documents in a foreclosure defense case. His attorney argued he was set up. Was he REALLY guilty? I don't know. Things are not always what they seem to be. His attorney said he was set up by the loan servicing companies working for the banks.
The Loan Servicing companies in large measure were at the forefront of the fraud that was perpetrated against homeowners across this nation. In the video with Lynn Syzmoniak who is an attorney and also an expert Forensic document examiner out of Palm Beach County, you see the loan servicing companies working for the banks, on a massive scale hired hourly, low income employees to create the fraudulent documents. Several of these low level minimum wage people who had been hired by the banks servicing companies, are interviewed in the 60 minutes segment. One young man, barely an adult, was tasked with signing a woman's name to stacks and stacks of documents all day long. Those signed documents in stacks were then provided to another low paid employee to notarize those signatures without witnessing the signature on the documents. Many low paid employees signed names claiming to be Vice President of banks. Again, contrast that to the Pasco County attorney. A loan servicing company claimed the attorney in Pasco county altered a document in his client's file. Maybe he did. He shouldn't have. He was convicted of it and was sentenced to nine (9) years in prison. He is in prison as I write this. Nothing however has happened to the people running and working in the loan servicing companies who generated massive numbers of fraudulent documents to be used in foreclosure proceedings across this nation. To this day NOTHING has happened to them. When the frauds were exposed the attorneys general for all the states got together and brought suit and just as Sheila Bair who was then the Chair of the Federal Deposit Insurance Corp suggested in the 60 minutes segment with Lynn Syzmoniak, there was a negotiated settlement which was in the billions of dollars. Florida Attorney General Pam Bondi and Rick Scott got $344 Million of those billions for Florida. None of that money went to homeowners which is where it was intended to go. There was no relief for those defrauded homeowners.
Where did the money go? Florida gave it to the Court System to hurry the foreclosure cases along. Homeowners lost their home faster and banks benefitted. And they are still often using those fraudulent documents today. Apalling doesn't adequately describe it!
The settlement which came after the interviews with Lynn Syzmoniak and Sheila Mair in the following 60 minutes video, changed almost nothing except to speed up the foreclosure process and the homeowners continued to lose their homes but at a much swifter pace. The settlement money was given out to the states and Florida's portion was $344 million. That money was supposed resolve these issues and right those wrongs. It was supposed to stop the fraudulent acts and yet those fraudulent documents are still being used in 2021. Lawyers submitting those documents knowingly have yet to be held accountable, despite the example made of the Pasco County foreclosure defense attorney who was jailed for 9 years for purportedly altering a document in a single case.
In Florida, Governor Rick Scott and Pam Bondi as the Attorney General at the time along with the Florida legislature decided that money should NOT be given to the defrauded home owners but should instead be given to the Florida Court System to help them clear the backlog of foreclosure cases. The courts then incentivized the speeding up of these foreclosure cases in order for the judicial circuits to get their share of the money. This horrible and unjust decision incentivized the courts to hurry those foreclosure cases through and homeowners were put out of their homes much more quickly. Reference Rocket Docket. A quick search online will provide ample information on Rocket Dockets.
A very well referenced and well written account of these events is provided in the excellent book People V. Money. (See link above). The author, an honorable man who wrote it, Mark Stopa, documents extensively how the Courts then were incentivized with that $344 million settlement money with the Florida Court Adminstration providing millions to the local Judicial Districts, (the judicial districts cover various counties, i.e., Broward is the 17th Judicial District, Miami-Dade is the 11th Judicial District, Palm Beach County is the 15th Judicial district, and so on), based on the clearing of the backlogged foreclosure cases. To get the money the districts needed to clear the cases and the cases were sped up. This in reality worked in the banks' favor and against the homeowners.. Here is the link to one of many articles about the one Pasco County, Florida attorney who was convicted of altering a document in his foreclsoure defense clients' case. Then contrast that with the discussion with Lynn Syzmoniak about the Loan Servicing Companies behavior and fraud on massive long-term scale across the nation where NOTHING WAS DONE ABOUT IT. Worse, the settlement stopped all discussion of prosecutions. R.I.C.O. CHARGES SHOULD HAVE BEEN BROUGHT. As you will see in 2nd video with Lynn Syzmoniak discussing what happened after the 60 minutes segment, she expresses that she continued to hope that prosecutions would one day happen. IT NEVER HAPPENED.

REFLECT-Compare and Contrast what happened to the banks, their servicers and their employers, their attorneys and others involved across this nation in this huge scandale. The loan servicers on behalf of the banks creating fraudulent documents on a massive scale and then the banks providing those documents to their attorneys who then filed those documents in the court filings as valid documents to take homeowners' homes. Even after the banks and servicers defense counsel have seen homeowners attorneys prove repeatedly that these documents were and are fraudulent, attorneys continue to file for foreclosure of homes in the court system with these same documents.

Those words begin the written opinion of United States Bankruptcy Judge Christopher M. Klein. The below link is to the Sunquist V. Bank of America, N.A. case. This written opinion is excellent although lengthy. It needed to be lengthy because a lot happened to the Sunquist family. The written opinion includes notes made daily by Mrs. Sundquist. It also outlines how horrific Bank of America acted along with their servicers and their other minions and Bank of America was held accountable in this case to the tune of 45 million dollars.
This is a case where the federal judge ruled for the homeowner and awarded 45 million against Bank of America. Despite trying, Bank of America was unable to get the judgement set aside.

This legal decision is very much worth reading. It will give you a deep understanding of what goes on during foreclosures. It doesn’t just involve the bank and the homeowner.
